Charge Offs On Credit Report
I included citi-financial in my bankruptcy. They entered a charge off on their part and it is listed on my credit report. They hired a lawyer which he put out a judgement and that is currently is on my credit report also. It seems to me that citi-financial did double jeapardy on me. Is that legal? Both the lawyer they hired and citi-financial were listed on my bankruptcy. I live in Utah. How can I clear up this judgement from the lawyer they hired? I declared bankruptcy in 2004:mad:

your credit history is your credit history. Filing BK does not erase that.

Not sure what this means though. Were you sued for the debt? Before, during or after the BK?

They sued me for a debt before my BK. I included them in my BK.

Okay so you have to figure out if this was discharged or not. Might be easier to call the lawyers office that did your bankruptcy and have them look and tell you. If they sued you PRIOR to your filing, there is a good chance that it was not discharged bc it was a prior judgement.

I must be missing something there. In a Chapter 7 bankruptcy, a credit card judgment would be dischargeable. The unsatisfied judgment may still appear on a credit report afterward, but a judgment debt can be discharged.

So my last question is if it was a prior judgement how do I get it taken off my credit report? In utah it is 6 years for the Statue of Limitations. How do I settle it so it won't haunt me anymore?

Unless they want to take it off, you can't. That was the point of my first post. It is your credit history and...
we all know those that forget history are doomed to repeat it.

A credit ding can stay on your report for up to 7 1/2 years and a judgement a bit longer. That is the way it is.
Just because it was discharged does not alter the fact there was bad credit in your history.
