Sexual Consent in Florida

If the girl is 16 and her mother knows and approves of her 21 year old boyfriend - are they breaking the law if they have consentual sex? when reading florida statute it looks like a 24 yo cannot engage in sexual activity with a 16 or 17 yo - and it says any minor under age of 16 is deemed unable to provide consent. so because she is 16, her mom says its okay, and the boy is under 24 - are they breaking any laws? thanks for clarifying for me.
