Possible False Arrest Claim
Arizona
A maintenance worker for AZ transportation dept. (while on the job) does a citizen's arrest (detained me for police to arrive) and then the charges against me are dismissed or found not guilty - Would I then have a civil case against the person who "arrested" me? or possibly against the company they work for?
False arrest or something along those lines? I know it sounds weird, but this road maintenance worker went berserk on me. Police never even bothered to ask my Wife or I what happened, gave me a citation and let me go on my way. The police in this case were DPS which is another division of AZ Dept. of Transportation.
What do you think?
Re: Not Sure What Kind Of Civil Case If Any?
There is more to the story. What did the maintenance worker state to the police the crime was? Which is it? The the charges against you were dismissed? Or you were found not guilty? It can not be both!

I did not catch that part in your other thread, I reread it. It seems they blocked you in and it was not necessarily a voluntary stay at the scene.
This possibly could be considered an arrest, but more in line with a restraint of liberty?
Whether restaint or arrest, unless based on false pretenses, I see no grounds for any legal action against them, but that is for an attorney to sort through ALL the facts.
If you are cleared in a court of law by alleged weight of the evidence that has been determined to be without any legal merit at all, then consult an attorney.
