Public Intoxication In Senoia Georgia
Hello, on a recent visit to see some relatives, I had stopped off to have a few beers and long story short, I received a citation for a public drunk. City Ordinance 6-6.
I called the clerk of courts and she told me the fine was would be $110 and that I didn't have to appear. Well I decided to wait until the last minute to pay the fine so I had to appear at the court date. GOOD thing I did!!! I plead guilty to the charge and figured I would just pay the $110 and go. WRONG!!!!!!!!!!!! The person who told me the fine was only $110 dollars and I didn't have to appear were WAY off basis!!! I was charged $762 and another $44 per month for the next six months, to the violent victims crime fund or some crap like that and sentenced to six months probation! :wallbang::wallbang::wallbang:
What the hell?!!!! I would have never plead if I had known I was facing THAT little surprise! I am from another state and now get to enjoy sending in regular reports to my probation officer and $200 payments each month!
My questions are these. I am from out of state and am currently looking for a job. I was never arrested nor read my rights. Is this a misdemeanor and if so, do I have to tell a future employer about this? Is it a conviction?
How long does this little beauty stay with me? Please help. The fine seems excessive as hell also. I looked at other public drunk fines in other counties and they were nowhere near what this bad boy was! What gives?
Re: Public Intoxication In Senoia Georgia
The ordinances are here (PDF); there's no ordinance no. 6-6. Did you mean 6-56, governing open containers?
It sounds like you pleaded guilty to a criminal ordinance violation, and criminal records last forever unless you get them expunged. However, Georgia criminal ordinance violations aren't abstracted by the Georgia Bureau of Investigation, and they aren't classified as misdemeanor convictions, so you may not even be asked about this type of offense and it is possible that employers won't detect it with a conventional criminal records check. You will need to check with the court about your specific conviction, to see if it was a misdemeanor or ordinance violation.

Thank you for the help. The officer wrote "Public Drunk" (City Ordinance 6-6) on the ticket.
I dont know what happened. Im still kind of stunned. I received no formal paperwork stating the nature of the charges against me and was never explained exactly what of the charges meant.
So, I don't even know where I stand in this whole mess! Does this seem normal? Was it my job to get an attorney to explain the charges against me? I thought that if you were charged with a crime, then the charges had to be explained to you.
This was a rinky-dink little court, but the legal system in Senoia seems to have mowed me over on this one.
