    Hi all,

    I would appreciate your insights about my situation. I currently have a working visa and working in Maryland for a year. I am a Filipino citizen and is currently processing annulment papers back home. The legal bearaucracy there is such that it takes many years to process the nullification of marriage. I have been processing mine for over 4 years now and my ex contesting it is not helping any.

    I would like to move on and know that once I divorce, marry and change citizenship our country does recognize the new marriage. However, I would like to know if divorce would be possible given the fact that I am only on working visa and that my ex is based in a foreign country.

    As long as you meet your state's residency requirements, you can divorce in your state. You don't need to be a citizen or LPR to divorce.

    Your spouse's absence from the country may affect how your divorce is treated by the Philippines; that's something you would have to discuss with a Filipino lawyer. Also, the court would not have jurisdiction to divide assets located in the Philippines, unless your husband consented to that jurisdiction.
