Divorce From An Overseas Marriage
Ok, here is my situation ... When I was still just a US Permanent Resident I married my wife in Lithuania, she was Lithuanian citizen (so was I as well). We've been married 6.5 years now. I have US citizenship and she has US Permanent Residence status. She lives in VA, I live in UT for now. How and where do I apply for divorce? Could I have divorce done in Lithuania? That would be my primamry choice. If not, which state do I go by? We have lived in many different states during these last 6 years.
Any input would be greatly appreciated.
Re: Divorce From An Overseas Marriage
You can divorce her where you are domiciled (apparently Utah) or where she is domiciled (Virginia). If there are marital assets to be divided, there are potential jurisdictional issues if those assets are in a different state (or country) than where you file. If you have questions about divorcing in Lithuania, contact a lawyer in Lithuania, but you can expect that as both of you are domiciled in the U.S., absent her consent a Lithuanian divorce won't mean much in the U.S.

But our marriage is not registered anywhere in US.
