What Are My Options After Filing Chapter Thirteen,and Cant Make The Payments.
I recently filed chapter 13 in the state of Ga.I have allready been to court as of3-14-08,I was informed by the trustee that I should have allready made my first trustee payment..was not aware this had to be paid before going to court.I had payed the 1st and 2nd mortgage.I recently lost my job three days before my court appearance,due to the owner dying,and would not have had the payment anyway..I cuurently have as my sole transportation a Harley Davidson Motorcycle.My question is,will I lose my house and my only source on transportation because of my chapter thirteen getting dismissed to a chapter 7,or,wolud I be able to drop the bankruptcy all together and keep my home..What are my options in this matter? Any help would be greatly appreciated..

You can voluntarily dismiss out of the Chapter 13 at any time, just speak with your attorney about doing so. Providing you are current on your mortgages and the motorcycle payments, you should then be able to keep both of those things, but your other creditors would again be free to pursue wage garnishment, etc. It's likely that if you still haven't found new employment and begun making the Trustee payments by the time confirmation rolls around, your case will probably be dismissed at confirmation... no matter what you need to speak with your attorney now to decide the best course of action.
