Landlord Is Giving My Security Deposit To Someone Else
This is a side issue from a previous post: http://www.expertlaw.com/forums/show...ighlight=lease
Summary:
Moved out early from a place I wasn't on the lease for and the other tenents threatened to take me to small claims court for the last two months of the rent. Legally, the house is only allowed 6 people and I was the 7th. Never signed a lease or agreement, and could have been thrown out if a housing inspector had come because I literally had no say.
I'm talking with the other tenents now to compromise, but the landlord, who I paid at $739 security deposit to, said he's going to send the entire security deposit to one of the other girls, who I know will not pay me my share.
Is there anyway I can make him send me my portion separately from the rest? He said the lease says he has to pay that girl the entire deposit and she's responsible for splitting it up, but I wasn't on that lease, so I didn't know why that applied to me...
I have the check copy that says I paid him the security deposit directly.
Re: Landlord Is Giving My Security Deposit To Someone Else
You can take him to small claims court and try to prove that he owes the money to you even though you are not on the lease. Or you can try to recover the money from your ex-roommate. The benefit of going after the landlord is that he can be reasonably expected pay you (out of the deposit); the downside is that you're not on the lease.
