    Can I Change My Parent's Custody Of Me At Age 20, In Indiana
    Hello, I am a twenty year old male that has been living on my own since I
    was eighteen. I am in the military and I go to college. I was needing to change my father's custody into letting my mother have legal custody over me for college and military purposes. Unfortuantely, I am not able to become independent until I am 23 years of age or I am deployed, therefore, I am a dependent of one of my parents. If both of my parents agree to the change of custody over me, then what steps would I have to take in order to make the change? Would I have to get a lawyer? Can I just fill out some paper work and get it over with?

    Yesterday, I went down to the Juvenile Department and asked if I could change the custody. They told me that I am over 18 years of age, therefore I am an adult. This is somewhat true, but I STILL CANNOT CLAIM INDEPENDENCY until I am 23 years of age or I am deployed.

    First, you have reached the age of majority, you are no longer a juvenile.

    Second, emancipation wouldn't work anyway. The reason being is FAFSA does not recognize emancipation (not that it mattered), but had you been an emancipated minor, it wouldn't be recognized for the purpose of being independent (you will be considered dependent unless you can answer yes to one of these questions - 2007-2008) when filling out the FAFSA.

    Now to get at what you may be able to do.

    Dependent status:

    You must provide information about your parents when applying for federal student aid.

    Quote:

    Who is considered a parent?

    If your parents are married, answer the questions about both parents.

    If your parent is widowed or single, answer only the questions about that parent.

    If your parents have divorced or separated, answer only the questions about the parent that you lived with most during the last 12 months. If you did not live with one parent more than the other, answer only the questions about the parent who provided most of your financial support during the last 12 months.

    If your parent has remarried after being widowed or divorced, answer the questions about both your parent and your stepparent.

    If you have a legal guardian, you cannot use your legal guardian’s information on your application. A legal guardian is not considered a parent in the financial aid process.

    If you have foster parents, you cannot use your foster parent’s information on your application. A foster parent is not considered a parent in the financial aid process.

    If you were adopted, follow the instructions above for parents, based on your parent’s current marital status.
    Now if you are still confused at what to do, you should consult with your school's financial aid office.

    SITUATION: My mother tries to send me money sometime, but I send her my military stipend while trying to support myself. When I come home to visit, I usually stay with her if she is in a shelter or if she stays over a friend's house.

    On the other hand, I do not stay with my father when I come home. He does not send money to me at all.

    ??? - May I put my mother down for Federal Student Aid despite my father having custody over me? I was told by friends that I would be able to since she tries to support me and that we send money back and forth to each other.

    As you've been told, you're an adult. You don't indicate that you're under a guardianship, and you indicate that you work and live independently. You're not in your parents' custody.

    This question appears to revolve around a college financial aid application, where your college is treating you as dependent for the purpose of calculating aid eligibility.

    Whether or not your school treats you as a dependent for financial aid issues is a separate question. What did your school's financial aid office say when you discussed your situation with them?

    Your confusing the two situations. FAFSA is totally seperate from your legal stance. Once your 18 your no longer under anyones custody except your own and it doesn't matter if you get money or give money to either parent.

    You need help with filling out your student aid forms. I'm unsure if your active duty or reserve but either way, someone on base should be able to help you out with these forms.

    You are a dependent on FASFA if you are in the National Guard or Reserves I'm guessing? Talk to the finacial aide office regarding changeing parents. They will be very helpful.


    "Select Yes if you are currently serving in the U.S. Armed Forces or are a National Guard or Reserves enlistee who is on active duty for other than state or training purposes." This would make you NOT a dependent

    "Select No if you are a National Guard or Reserves enlistee who is on active duty for state or training purposes." This would make you a dependent
