Piercing The Corporate Veil
My name is Kate and I recover civil money judgments for a living in North Dakota. I have a judgment out of South Dakota against a dissolved corporation. The judgment is for around $23,000 not including interest, and the former president of the company was at one time going to just settle the judgment, but he has now backed out of the settlemen. So I am now going to attempt a corporate veil piercing. I have already done a debtor examination with both officers of the corp and have found out that this little corporation was a total sham, so I have a really good case. My question is, how do I begin the action necessary to proceed with my case. I know the arguments I must prove in court and am in the process of figuring out the documents I still need to subpoena to do so. I have already subpoenaed stacks and stacks of papers which I'm still going through, but I'm just not sure the process for proceeding. Could anyone help me out by filling me in on what I must do now?

You will need to hire a local attorney to file the lawsuit. What you are doing would probably be considered the unauthorized practice of law here but may be OK in North/South Dakota.
