    Ok, I have been reading about different options as far as the marital home goes. The option that looks like the best is to have the party that actually wants the house to refinance the house in his name alone and "buy the other partner out." my question is, will this relieve the other party of any liability as far as the home goes? And what happens if the other party cannot get the home refinanced in their name? How does the person that is giving up their right to the marital home make sure that they will not be held liable for any damages in the future? Also, how does the person giving up their rights to the home make sure that they get some money out of the deal?

    You work out an agreement and have your attorneys submit it to the court for approval. One of the attorneys can then draw up the necessary paperwork and deed.

    Your questions need to be addressed with a real estate agent and a divorce attorney and possibly a financila planner. There are too many variables here for anyone to answer with any certainty.
