    Felony For Non-Support Issues In Michigan
    The bio-father was charged with felony non-support in Michigan in Dec.'07. He was given 90 days in jail (served 64), 5 years probation, and is to pay an additional $253 per month toward the arrearage as well as his regular child support order. He was released the 13th of Feb. and has not bothered to keep up his obligation. I am in contact with the FOC on this because his attorney did not file a "stay" on the support while he was incarcerated nor has he paid for Feb. and so far nothing in March. I was told to contact his PO but he told me straight out that he did not want me to contact each month that he misses but to wait for several months to pass....and then he "may" violate him. He stated that most likely nothing will happen to him because they will not put him in prison for not paying. Also informed me that I am not the victim and that I should not contact him. During the court time, the Judge stated that he was not to miss a payment of either the arrearage or regular support. Also, the bio-father had claimed that he lived in Michigan when in fact he lives in Ohio. I had brought this to his PO's attention prior to the court hearing and the bio-father changed his tune and gave the Judge his mother's address in Ohio claiming that he only stayed in Michigan once in awhile. (He claimed to live in MI when I tried to have the case moved to Ohio....provided a driver's license and fake rental papers to a trailer he never lived in)....the magistrate in OH sent the case back to MI and that is when I went for the felony conviction.) The Judge ordered that the probation be sent to Ohio. Per his PO I am told that I have no right to that information and that it is not my concern.

    Can I contact Ohio to see if the probation was sent there? Or who do I talk to? The FOC was not impressed with the fact the PO is not willing to violate him.

    Also, bio-father had supervised parenting time one hour every Saturday. When released he tried to have that reinstated but the court made the decision that if he truly wanted to see the girls that he would have to petition the court to do so and so far he hasn't and it has been over a month since his release.
    How much time do they give him to file for parenting time? I was told that most fathers file within the week of being released and he hasn't. He does not have a bond with the girls and has done unspeakable things towards them.

    What can I do - other than contact my attorney, the FOC etc? My daughters' well being is the most important thing and IF child support is not paid - he does not bother to see them. Sounds sick - but true. And how far will the State let him go before anything is really done? Victim's Services gave me a web site to where I went to see his probation guidelines....it states that he is not to leave the State of Michigan without permission. He doesn't live there. I don't understand the guidelines that they have set up for him.
