Stealing At Apple
Hello,
Recently, my friend was at a mall in California and stole 2 earphones from an Apple Store worth $100 each, basketballshorts from Finishline which cost $30, and a sweater which cost about $30.
Though the shorts and sweater are not of much consequence, what he is worried about are the earphones. After he had put the earphones inside a bag to walk out of the store, I noticed from outside the store that one of the workers was eyeing him suspiciously and looking at the bag.
After i had told my friend that, he became very paranoid. He was scared that he had been caught on tape. So my question is that if the workers did not stop my friend before he exited the building, but had a tape of him putting the 2 earphones in his bag, can he be charged with shoplifting.
If so, how would they be able to find him, as they were not able to take down any information about him.
Thank You in Advance.

Re: Stealing At Apple
Yes you can be arrested especially if you were followed and your plate numbers were jotted down.

Re: Stealing At Apple
He could be charged, if they have evidence and are able to identify and find him.
We don't know what type of security cameras the store may have or if they would be able to do any of the above, but it's possible.

Re: Stealing At Apple
If you are caught and its also discovered that you stole from multiple stores you could be charged with a Felony (burglary)

Re: Stealing At Apple
Hmm, i see
however, we happend to leave by metro bus, and travled around in cabs and im 100% sure that they did not follow us or take down license numbers
My friend is a minor, 14, by the way.
All your responses are said, presuming the fact we were caught.
However, i would like to know if its possible for them to even catch my friend. Even if they had him on camera, how would they be able to find him? Are teh chances that they would be able to find him high, or just the opposite?
Thanks in Advance

Re: Stealing At Apple
Yes its possible. You might also stay away from that Mall for a while as well

Re: Stealing At Apple
Hm, yes, he will most probably be ever going to that mall
Does it still count as a felony, even though he is a minor?
And do you know about hwo much percentage chance he has of never being found out?
Thanks

Re: Stealing At Apple
A felony is a felony regardless. I could be mistaken but I do recall several cases in CA where minors or adults shoplifted from multiple stores and because of this were charged with felony burglary

Re: Stealing At Apple
Ditto that.
If caught, and they found he stole from several places, he will be charged for multiple counts of PC 459 as a second degree (commercial) burglary.

Re: Stealing At Apple
i see, thank you
final question, do you know how likely it is that he will be caught?
Also, what would happen if the felony charge takes place?
