Getting Ex To Move Out, in Kentucky
A family friend of mine is in the following situation. She has been cohabitating with a man for at least 10 years. She owns the house that they are living in. He has put money into the house for home improvement in the past. Now they are having problems and she wants him to move out, but he refuses because he says he is entitled to half of the house. She does not have money for a lawyer because he has put them into serious financial trouble. Would he be entitled to half of her house because they have lived together for so long? There is no written contract or agreement. Also, is there any way for her to force him to leave? He has not been threatening or violent. The situation is in central Kentucky. Thanks.

Kentucky law does not recognize "common law" marriage:

    Quote:

Kentucky does not recognize common-law marriage and no contractual rights or obligations arise from mere cohabitation. It has long been the law in Kentucky that [r]ecord title or legal title is an indicia sufficient to raise a presumption of true ownership.

    She can evict him.
