    Can I Legally Force Him To Refinance?
    I was divorced and in the decree it states that he is to refinance or sell the home. He is currently trying to sell the home but is getting behind on the bills. He keeps telling me he is borrowing all this money to pay the bills but is going out. A quick claim deed just takes me off the house but how do I get my name off the loan. Can I legally force him to do so?

    What is the exact wording in the decree?
    Maybe there is something in there that will help...

    Until then...If the home is listed in the MSL, has a sign out front, open houses etc. - then it shows he is putting in a good faith effort to sell it - unless you can prove otherwise. The market is not good - and I can say that without even knowing your state...

    The only way to get your name off the loan is determined by the bank. Most require refinancing, which he must qualify for based on his income/assets only - sometimes impossible to do based on your personal situation.
