    Hello I'm california.

    My husband has a job. He is currently looking for a new one. We dont know long that may take. Anyway the new renewal for his cafeteria plan 125 is coming up....my question.

    If we put for his medical expenses for the year lets say $3,000 will he have to pay it back if he gets a new job within the next 2 months... Im a little confused about this.
    He really is trying hard to get a new job but at the same time he want to make sure his dependants needs are met in case it take longer than he expected.

    Are you talking about an FSA plan? If so, no, you will not have to refund the monies. Medical FSA plans are use-it-or-lose it from both directions.

    If you leave the employer having used more of your medical FSA plan than you've had deducted, that's too bad for the employer. They cannot ask you to repay them.

    If you leave the employer having used less of your medical FSA plan than you've had deducted, that's too bad for you. They have no legal obligation to repay you.

    Yes I am talking about FSA....thank you!!! He was quite concerned about this if he was able to find a new job..You have been extremely helpful....
