Shoplifted In Ohio

i did something totally out of nature for me but am willing to take responsibilty. i just have a few questios- i offended at a walmart in ohio the total was 180.00 i was wondering what is the worst case seniro and if i enrolled in a educationl program would the judge take that into consideration? i am wanting to do a program through the nasp. thank you ahead of time for all your time and help

NASP has programs the judges smile at but they have limits and may not be in your area. CASA also has programs and are nationwide. I have contact info for both if you PM me I will give you that info if you wish

thank you for your reply. this is my first offense and it was a stupid mistake from the start so i wanted to do what i could to show the judge that it wont happen again.do you know what the chances could be of jail time? i have no criminal record at all other than 2 traffic tickets

jail is very unlikley and you might talk with a criminal defense Attorney. Your spotless record will have a theft conviction on it if found guilty. Talk to an Attorney and ask about available Diversion programs and if you qualify

Diversion programs vary and are not available everywhere. In short most act like guilty plea however once you complete program no conviction apperas on your record. If you cannot afford an Attorney request a public defender

Even if denied diversion, misdemeanor sentencing guidelines, IF convicted, seem clear as to what is expected of a court.

One aspect of a court granting diversion is how remorseful the offender is. You need to make it clear how sorry you are for this breach of law and trust and assure the Prosecutor/Court you will "never do it again".


The court's take notice people make mistakes in judgment and they are not out to incarcerate every person who does so.

Bottom line, ask about such program under Ohio law and be very polite to the Prosecutor/Judge. Dress nicely for court, it makes a lasting impression.

A 1st time shoplifter is considered very much a NON risk to be a recidivist, as this is the purpose of diversion programs.

The court will also take into consideration the care and welfare of your children and will more than likely, IMO, grant diversion. You must relate you are not a bad mother, and made a terrible mistake and are repentitent.

thank you for all your advice and help. i regret this everyday and hope there is no jail time involved because of my children. i have had a lot of stresses with being a singlle mother and im not under no reasons using that as a excuse because there is no excuses for what happen other than stupidity,carelessness....etc.i need to stay at home due to the disabilties of both children so i hope the court understands that and will work with me. i babysit in my home to make a little extra money to help support us besides the kids disability benefits. thank you again

The court, for any "1st" offender takes into consideration many factors. You are a good example of why leniency will be offered, that is, your children's sake, most of all.
