    Promotion Of Sexual Act With A Minor, in Florida
    i recently had a 17 yr old ( turning 18 in a couple of months) who lived with me. She wanted some pictures to send to her boyfriend in another state so i agreed to take them.as we progressed she started undressing, i wasnt sure but she said she was fine with it so i stupidly continued. she ended up emailing these pictures to her b/f and other boys to tease them. we ended up getting into a huge fight and i told her i was sending her back home with her parents so she ran to the police and told them about the pictures. so now i am in deep trouble but the wild thing is that the state released her to her 20 yr old b/f so she could live with him and his mother( state treating her like an adult not a minor). so here are the issues that she was the one who sent the pictures so how can i be charged with sending them? from what i know she has since left her b/f and moved back home not wanting to ever to return to the state so what happens now that the primary witness refuses to testify?

    A: You were an accessory (or, perhaps, the perpetrator).

    A: It depends on what the charges are; if the charge, for example, is possession of child porn, you may be found guilty (based solely on your statement of facts).

    Unless you can prove that she took the pictures herself (she didn't).
    Unless you can pull out a tripod that she owns or could have used (you can't).
    Unless you can prove that you had no knowledge of what was on the hard drive (you did).
    Unless you can prove that you were not there at the time that the pictures were taken (you cant).
    ...and if you told police what you told us without the presence of an attorney...
    ...you are screwed like a #2 Phillips with in a Electric Drill. You need an attorney yesterday.

    You have Promotion charges at a minimum and posession of child pornography at a maximum. The Felony Arrest will show in background checks regardless of what happens.

    The actor (child) need not be present for prosecution of the photographs. At the time they were taken she was under 18. The prosecutor can pull her birth information from Social Security and her County's vital statistics office.

    If convicted, either charge will result in your normal life effectively coming to an end. Being a Registered Sex Offender for 5-10-life will suck. Someone will find that you are in prison for a "Child Porn" crime and you will be turned out for things like a pack of cigarettes or a pair of shoes or maybe even some protection. You will be abused in prison. Being confined to solitary will result in mental illness, but will at least prevent you from being raped or molested.

    If you haven't seen the 2 Dateline To Catch A Predator shows you might want to see them. Florida is serious about cracking down on crimes that affect children.
