Fraud, Forgery And Other Money Crimes
I hope someone can provide me with much needed legal info.
Over the passed 3 years, my friend and me have uncovered extensive fraud, forgery, deliberately witholding information, as well as deliberate misrepresentation of benefificary inheritence from his father's Will by BOTH of his siblings. Amazlingly, one of the Beneficiaries (siblings) acted as the Trustee for FOUR years without Court approval or appointment.
Anyway, we KNOW at minimum that their illegal shennanigans (i.e. misappropriation/stealing of funds/assets/property, etc.), involved NO LESS than $45,000 and as MUCH AS $100,000 to about $300,000 dollars.
Right now we have EVIDENCE of at least TWO crimes, but I am desperate to find out the statuates of limitations for a criminal prosection.
The larger of the two frauds/forgeries KNOWN, occured back in 2002; however, my friend only became aware of it less than one year ago.
Can anyone "in the know" please provide some guidance on this matter, as well as any legal opinion(s)? Also...Yes, it is my friends intention to go to the police and open an investigation, but they are concerned about statuate of limitations.
Note: Most of these crimes occurred in NY City; however, some technically took place in Virginia because that's where the property (not the perpetrators legal residence) was located at the time of sale.
Also, can anyone advice on mail fraud since many FALSE, FORGED, and/or MISREPRESENTED documents were sent via U.S. postal service to perpetrate these crime(s). :wallbang:
Thank You
Re: Fraud, Forgery & Other Money Crimes
Your friend should have reported all this to a lawyer when he/she first found out. Generally the Statute of Limitations starts tolling when the discovery of a crime or damage is first known, but there are quite a few exceptions.
Report this all to a lawyer and/or the probate court right away.
