Full Custody And Changing Child's Name
Hi I was needing some help on my current situation with my son. I live in Texas and I was wanting to know if their is any way to change my son to carry my surname rather then his fathers. I also want to do this the most descrite way possible. My son is only 18 months so i want to get this over with now, and his father isn't really ever around. He is court order with child support but he doesn't even pay it. And the only reason he actually sees his son is if his mom has him over at her house. (meaning my son's grandmother) I would also like to know where can i go to get started with the name changing process. I don't even know where to start!
    Please Help!

The first thing you do is get the father's consent.

Because the law says that both parents must consent to the name change of their minor child, or have a good legal reason why the court should allow the name to be changed (because I want to and he doesn't pay support is not a good, legal reason)...

    that's why.

Without the father's consent, you would have to convince a court that the name change is in the child's best interest. The father can oppose your petition.
