    I've been a permanent resident for almost 9 years. I'm now trying to apply for my citizenship. I had a DWI charge (1st Offense) in 2006 in NY. I payed my fines ($ 475) and did community service (35hrs). I've never been arrested before this nor after.This is the only charge I ever got.

    Q1.Would this still be on my record.
    Q2.Is spending overnight in a precinct considered jail time.
    Q3.How will this affect my naturalization process.

    please advise...

    You committed a crime, so of course you have a criminal record.

    The question of whether or not you were sentenced to jail (e.g., to "time served") is not something we can guess from your spending a night in the drunk tank. Obviously you did spend that night in jail.

    It probably won't affect naturalization, beyond possibly slowing things down and inspiring a host of additional questions, but we can only speak in probabilities.
