Your question was "Does it matter where I file?"

My question was NEVER "does it matter where I file?"

Did you even READ my question? It sure doesn't seem like it...

The tone of this exchange should have been a bit more elevated, but I'm not interested in playing babysitter to somebody who cannot follow the instruction of a moderator. jadedone, find a different forum - that's the only way you'll get a different answer.

You have been repeatedly told that you have to file for emancipation in the state and county of your legal residence. You have been given a link which gives you the emancipation laws for every state. We can't change the law for you.

That still does not address my question, and I even stated in my very first post that I had read the law in North Carolina, and was aware that you must be a resident of the county in NC for six months before you can petition for emancipation. What I was asking was can I petition to north carolina while I am temporarily living in tennessee, because I am still technically considered a resident of NC and my driver's license has my parents address on it.

No one addressed this question, and it's all I wanted to know, instead everyone continues to attack me telling me I'm an idiot, and that no matter what, I will not be a candidate for emancipation. I am sorry I said it was XXXXXXXX to attack and insult a teenager on the internet, but I felt by the way I was being treated, that it really was ridiculous. The first time it happened, I requested that I not be talked down to, but that made them worse, and they called me an idiot, etc. I do apologize for disrupting your forums, but I did not mean to stir trouble, only rephrase my question.

    Thanks for your time.

No. You cannot petition in NC while you are living in TN. You can ONLY file WHILE YOU ARE RESIDENT in NC.

You've been told that several times, but evidently you are incapable of understanding what you have been told.

From what you have said, you don't reside in North Carolina.
    Quote:

Quoting North Carolina General Statutes § 7B-3500. Who may petition.
Any juvenile who is 16 years of age or older and who has resided in the same county in North Carolina or on federal territory within the boundaries of North Carolina for six months next preceding the filing of the petition may petition the court in that county for a judicial decree of emancipation.

I see. I believe this is where the confusion is. NC obviously doesnt know I'm living in TN, as far as NC is concerned I'm still residing in my parents house. Obviously I am not, and my specific question was can I petition from TN as a NC resident, or do I need to move back. Based on your answer, I would assume I need to move back before I can petiton - and not let NC know I lived in TN. Would you say this is correct?

As you have been told over and over you need to seek emancipation in state you legally reside! Furthermore your chances of success are very very slim. From what i have seen less than 1% of all petitions are successful. However you were given link to statutes so you can go from there

I am aware. The nature of my question is dealing with the difference between legal residence and physical location.

I have already answered your question. As clearly and succinctly as I can.

If you can't find the answer in what's been stated, you'll never survive the legal process.

Or is it just that you're waiting for someone to give you the answer you want to hear? If that's it, let us know now, I'll tell you what you want to hear, and we can all go home for the night.
