    Another question
    They said when I complete the diversion program I can get this removed from my record. I am a teacher. I have to have background checks. Will it still appear when they do a background check?

    If you complete the diversion program you're not being formally charged with a crime, so that part shouldn't appear, but you were arrested and that might.

    I recommend that you hire an attorney (you probably do not quailfy for PD) to be sure that this does not show upon the completion of the diversion (criminal record) and that no one tries to make an example out of you. Once completed, and you are asked if you were ever convicted of a misd, you are legally entitled to say no, bc this is not a conviction. It is just in your best interest to at least consult a criminal defense attorney. The arrest is most likely going to show up (arrest record) as Ohio requires all teachers to have background checks. I'm not sure what the implications this will have on your future job search/license.

    do I need a lawyer if the judge told me I qualify for the diversion program. Some have said I do and some say I do not. I cannot use the public defender as my income is just above the limit.

    sorry, I just saw your replies. Wont the expungement process erase the arrest for the background check?

    Sometimes yes, sometimes no, they are two different things, which is why I suggested to consult an attorney. See if he can do something for you about the arrest. Your gambling with your livelyhood here, it's not something that you want to regret later. You don't have to have an attorney represent you but you should at the minimum consult one. A local attorney will know the court system and the judges better than anyone here.

    Does anyone out there know if you can get the arrest record expunged in hamilton county ohio if I went through the diversion program and the charges are dropped? Also, how long will an arrest record show up on a criminal background check. I heard somewhere it is gone after 7 years. Thanks
