Dealership Has Payment, Repo'd Truck And Personal Property
HELLO EVERYONE, I AM NEW TO THIS FORUM.
I have a question.
We purchased a truck from a dealership in Orlando, FL that was advertised on ebay. They advertised that they accepted capital one auto finance as third party financing. After speaking with the dealership, we went and bought the truck. They accepted payment from capital one auto finance. After about 8 weeks, they called and said that they had lost thier privilages with Capital One and that they could not cash the check that I gave them. I told them that if they cancelled the check or returned it, I would submit new payment to them. I did this in writing. I did not hear back.
I walked outside and my truck that I had paid for was gone. I got no notification whatsoever from them.
These are the questions I have:
1. How can they keep my payment, take the truck, and keep my pesonal property, and my down payment which was cash?
2. Can I recover my down payment and personal property since they never technically "sold" me the truck?

First step is to stop payment on the check. Second step is to go talk to the dealership. They have no right to your personal property so they should allow you to retrieve that with no problem. As for the down payment, you will have to see what they say and go from there.

They refuse to return my calls and will not return my property. What can I do??

Sue the bad people in small claims court.

You might send them a certified letter return receipt requested indicating that if they don't contact you & return your property, you will sue them in court. -- or you can just go ahead & sue them in court (small claims court if the amt. qualifies)
