Seeking Emancipation In West Virginia
i will be 17 in june. Me and my mom have never gotten along and it seems to be getting worse. I dont know how much more i can handle. I want to move out but i know she'll never agree to it.I can take care of myself and my fiance will help.I wanna wait a few years before i get married plus mom would never agree to it. He's 18 and i know she'll try to get him in trouble, he has enough to deal with at the moment. I know i could be emancipated but i have 2 little brothers and i cant say much because i dont want anything to happen to them.please help...fast:wallbang:

You must be self supporting.
No judge will emancipate a minor to live with her boyfriend.

I am self supporting. Ive lived alone before and ive basically been taking care of myself since I was 13. I'm not wanting to be emancipated so I can live with my boyfriend! I was gonna get my own place and him have his but we thought it would be easier to get one together and I'd have a better chance to be emancipeted because I'd have definate support. I wanted to get roomates anyways cause when I go to college I'll have to cut back on job hours.I need to get out of the house now , it's not the best enviorment being yelled at and put down everyday among other things. It's NOT a healthy relationship between my mother and I and it never has been.:(

I understand your anger and frustration, and I agree that being yelled at and put down is not healthy.
However...
You are not a candidate for emancipation. You must show the courts that you're ALREADY self-supporting. "Basically taking care of yourself" won't fly.
You need to already be working full-time, paying your rent and utilities, buying your own groceries, making all of your own car and insurance payments (if you have a car), and seeing to your own health care costs.

I want to explain something.
Emancipation is not typically granted because the child WANTS to have it. It is granted to children that NEED to have the rights of an adult to survive.
I haven't heard of ANY cases in recent memory where a child was granted emancipation while still living at their parent's home.
Even in cases where the parents sign the paperwork, the child must already be living on their own for it to fly.
Emancipation tends towards the very rich and the very poor. In both cases, the children are already paying their own way and are already taking care of themselves in the absence of parents.
You have a roof over your head, food in your belly and clothes on your back. You haven't paid for them. Therefore, you are not a good candidate for emancipation.
