    Changing Child's Last Name In Texas
    I have a 12 yr old daughter, her father lives somewhere in ok, we have not heard from him in 2 yrs and before that it was 5 yrs. He is currently around 24,000 in back child support. I will be getting remarried and my husband would like to adopt her. Can we claim abandonment and have his rights terminated. If not what if we can not locate him. We are in tx.

    Grounds for involuntarily terminating a parent-child relationship in Texas include situations where a parent "voluntarily left the child alone or in the possession of another not the parent without expressing an intent to return, without providing for the adequate support of the child, and remained away for a period of at least three months," or "failed to support the child in accordance with the parent’s ability during a period of one year ending within six months of the date of the filing of the petition", Texas Family Code, Sec. 161.001(1)(B), (F). You can join a petition to terminate the father's parental rights with a petition for step-parent adoption. Texas Family Code, Sec. 162.001(b)(1).

    Thanks for the help, how long do we have to wait after we are married to file for adoption? can we do it before marriage?
