    Changing Locations And Taking My Daughter With Me
    I currently live in Southern California and have one daughter who is almost a year and a half. I have been living with my boyfriend (who is also my daughter's father) since I was pregnant. Him and I have not been getting along and I feel it's best for me and my daughter to move away. I want to move to Northern California about 6 hours away from where I currently reside. How do I go about doing that? I have a feeling it will be a fight because my boyfriend will not want me nor his daughter to go.

    Did he sign an acknowledgment of paternity when the child was born? Do you have a child support order or parenting plan?

    You are free to move anywhere you want but you are not free to take HIS child with you. How would you feel if he moved 6 hours away with your child? How is it in the best interest of the CHILD to be six hours away from her Dad that she is used to seeing everyday? If you move without permission, in writing, from Dad or permission from the courts, Dad can file for emergency custody and the immediate return of the child to the courts jurisdiction.

    You need to file, before you move, for primary custody and permission to move. You will have to show how it is in the CHILD'S best interest to move. IF you are given permission you will most likely be order to provide most, if not ALL, the transportation for Dads visitation of his child.
