    DUI And Possession Of A Controlled Substance
    I was arrested on a DUI and possesion of a controlled substance charge.I am a first time offender. I am in Ca and wanted to know what the punishment will be.

    That depends ... specifically, what charges do you face (code sections, please)?

    I see hefty fines, a license suspension, and counseling in your future. Whether you might face jail or whether this can be plead down depends on the specific offenses.

    The code sections are HS11377(A) and VC23152(A)(B) would it help if when i show up to court for the arraingment show proof of enrolling with a drug program and could i still be elegible for DEJ?

    I would consult an attorney before you admit to entering ANY program ... it might show some level of guilt on your part.

    But, if you feel you have a problem, please DO get help right away!

    It is possible that you can get Prop. 36 (PC 1000) for the drug possession, but the DUI might be a hit you'll have to take if the DA is not willing to deal. This is why you need to speak to a local attorney. There are a number of possibilities, and with luck (a cooperative DA and a decent attorney) you might be able to get away with fines, probation, counseling, and deferred entries of judgement (i.e. a dismissal upon completion) all around - plus a license suspension.
