Ok so my ex-wife wants custody of our daughter, and she wants to move with her! Well we are in Texas and ive been looking all day for what the law is on WHEN SHE CAN CHOOSE WHO SHE WANTS TO LIVE WITH? Thats my question...when can she choose who she wants to live with? Also my ex-wife has a warrant out for her arrest so does that come into affect?
PLEASE HELP!

Your daughter may be able to fill out an affidavit of preference if she is of age...I believe 14 is the age in Texas. Your wife will have to have your WRITTEN permission or permission of the court to move out of the courts jurisdiction. If she moves without either you or courts permission file a motion for custody and for the child to be returned to jurisdiction.Quote:

I have a hard time believing that a Judge would award custody to a parent that has already shown that s/he isn't willing to support that child. what if they prove im not a good parent? my daughter has ways to prove that i may be unsuitable! she skipped school and i didnt even know about it till her teachers told me and alot of other things!

well she had unprotected sex at school with a guy, and almost was pregnant! she got caught at the house last summer with a guy that was 19 she is 15 and was 14 at the time, but they didnt have sex cause we got her checked! she is failing her classes at school! she forged my name to notes to get her out of trouble in school!

i also heard her say that she is going to runaway to a state where she can get married without a parents consent if i dont let her live with her mom!

Your child is having a major psychological crisis. The father, mother and child should seek FAMILY counseling immediately. I'm sorry I have no legal advise other than for you to hire a lawyer - but from my point of view neither parent is being successful at raising this child.
You and the mother can continue to fight against each other over custody and money while the child continues to act out - she is the one who is ultimately suffering. -
