Paternal Abandonment/Neglect in Illinois
:confused: I am from Illinois and have 2 friends who are dealing with dead beat dads. The one friend has 2 children whos father has a history of mental illness and exposing it to his children against the mother, yet he hasnt been around in almost 2 yrs, no contact besides the mother having a police report filed against him, no support, and the children want nothing to do with him either due to the traumatic scenerios theyve witnessed. How does she go about eliminating any rights the father may have due to the situation or have would you limit the rights as much as possible? The second friend has a 6 yr old daughter who hasnt seen her father since she was less than a yr old. He has made no attempt to contact them, and a few years ago she also had a restraining order against him. The daughter has no idea what he father even looks like nor his name. She wants to know how to change the name and if possible exterminate the rights of the father due to abandonment.

Do either of these woman have a husband that is willing to adopt? Are either of them on state assistance? Is there any custody order or child support order?

Neither has a husband willingto adopt, no custody orders, no child support orders and what do you mean by state assistance? (e.g. food stamps, medical card?)

Yes. Food stamps, medical, cash...etc..
Well if paternity hasn't been legally adjudicated neither father has any rights to be terminated. Both women should file for child support. These children have a right to be financially supported by both parents. It is doubtful that a Judge will terminate the fathers rights unless there is a step-parent willing to adopt...especially if the woman are getting ANY KIND of assistance.

thanks youve been really helpful. so to get this completely straight, if neither has had a court ordered paternity test neither father has any real rights unless notified and if both mothers are completely independent without any state assistance they have a better chance of gaining parental independence via court system but if they have state assistance the reason for obtaining child support which would be to compensate for the assistance givin by the state.
