Petty Theft Caught On Tape
I live in California.
I was at one of the department stores picked out one of the jeans (about 200$) and noticed that the security tag wasn't secured tight. it was loose enough for me to force it out. i was able to do it and when i walked out of the store i was confronted with undercover guards. as soon as i noticed i was busted i just took of and ran away. i am sure that i was being recorded on the video tapes. I ran to my car and i made sure nobody was running after me. but as i got away in my car i think that somebody saw my license plate. if i receive a letter or something, what should i do? by the way, when i ran away, i threw the jeans down so is this considered attempted shoplifting? will the store even investigate in this situation to find me?

It is still theft. You may not get a letter you could get a call or even a visit from PD. You should talk to an Attorney and discuss how this will be dealt with if they indeed discover who you are.

You left the store with the merchandise it is considered shoplifting. If you got a letter like you said it sounds to me like they did investigate it, and are now seeking civil and or criminal prosecution. You should contact a defense lawyer and explain your situation.

You did not "attempt" shoplifting, you actually shoplifted. AND, hardly anyone will send you a letter about it....most of the time folks in your type of situation get a predawn wake-up call delivered in person by an officer or two!

well if i contact a defense lawyer, what is the most i can get out of it because i am guilty. also if they dont look back at the video tape and have the security guard as the witness, will they still be able to prosecute me with just the witness?

Successful prosecutions happen all the time with nothing more than eyewitinesses

i see. i also have another question: i was with a friend and if they should contact me, cause it was my license plate will they ask me about my friend and who he is? how should i respond. i would like to keep him trouble free tho.

If you lie to Police you can be charges with obstruction. If asked tell the truth!

You never tell an officer anything other than "If I am under arrest I would like to speak with an attorney" or "I will be happy to speak with you, but would like the opportunity to interview and retain an attorney, or be provided a public defender prior to answering any questions."
The police are going to show up to ask questions which almost always leads to an arrest. Miranda does not apply until after the cuffs are on. By that time they have all the evidence they need.
