    Marrying a Immigrant Who's Tourist Visa Has Expired
    My fiance came here on a tourist visa two years ago from Panama. The visa has exspiered and he is still here working and living. He has never been in any trouble and we would like very much to marry. We are not particulary concerned about the green card but we hope for one some day. I am told by the probate court that we can not obtain a marriage license without a valid visa. Is this true? Is there any way around this? We just want to marry and have a familly. Are we going to have to pay a lawyer for help because we are not rich and I have heard that it is pretty exspensive?

    Dear Tumani,

    In general, one does not need to have a visa/a valid visa/a valid immigration status in order to get married. I do not know in what State you reside, but typically a couple receives a Marriage Certificate at a city hall. There is no need for a court (especially a probate court dealing with wills and estates).
