    Daughter Charged With Statutory Rape In Tennessee
    Hello,

    I need help. My daughter is a 24 years old, she is still a student and wanted to become a teacher.
    Recently, in a student party, she was caught having sex with a 14 years old boy, the brother of the girl who received the party. My daughter and the guy were drunk. The guy is a soccer player who looked older. It's the guy's sister who surprised the couple. She saw my daughter performing oral sex on the boy then my daughter riding the guy for vaginal intercourse. She was naked.
    Two days later, my daughter was arrested at home, handcuffed and led to a judge who charged her with "statutory rape". She is now free on bond. My family is upset. My wife cried when she saw our daughter handcuffed.
    Our attorney wants a deal, but says that my daughter could yet have serve jail time and have to register as sexual offender. My daughter is a good, a serious girl. She isn't a bad girl. She isn't a criminal. She is scared of being locked up with bad women. She knows what happens in women's prisons, specially for a pretty girl.
    We need help. How long could be she jailed ? What means "register as sexual offender" ? For a job, a carrer for instance ? How can we avoid incarceration ?
    I can't understand that one sexual intercourse could destroy my daughter's life. The intercourse was consensual. My daughter ignored the boy's age. My daughter is on birth control : she takes pill. No fatherhood is possible.
    Did you really think that she can be jailed ?

    Yes, she can be incarcerated and she very will should. A 14 year old cannot consent to sex. Your daughter had sex with a child, she is a criminal.

    If your 14 year old daughter was seen having sex with a 24 year old man - you can bet your life you would think he should be charged with a sex crime.

    Yes, I'm serious. I'm afraid for my daughter. For me, the guy insn't a child. I saw him. It's a teenager. And it's difficult to compare 14 years old boy and 14 years old girl. A girl can be knocked up, not a girl. Maybe my daughter made a mistake, but did you think really she is a "criminal" because she had consensual sex once with a guy in party ? A criminal is a killer, a peadophile, not my daughter. I think she doesn't deserve incarceration. Why do you think differently ?

    It doesn't matter, the boy is still a CHILD. Get that through your head. Your daughter had sex with a child and is therefore a criminal. If the 14 year old was your child, wouldn't you want the person to be incarcerated?

    What we think is irrelevent. The LAW says that the act she committed is a crime. No person under the age of consent (14 is UNDER the age of consent) is legally recognized as being ABLE to give consent - even if he begged for it, it is NOT consentual sex under the law.

    You unterstand that your answers are difficult for me. You have a good girl, a student, perhaps a future teacher, very serious. She goes to a party, drinks, has sex with a guy (I don't know how it happens) and the day before she is a "criminal" and you say she deserves incarceration. Isn't it the same person ? Who was hurt in that case ?
    But do you think that the incarceration could be long ? And what about jobs after ?

    If you are saying that she knew he was 14 and ignored it and then had sex with him? If you are, think about what you are saying and don't say it again to anyone.

    She did not do this. She had sex with a person not old enough to give consent bc in the eyes of the law, he is a child.

    This means that she will have to report where she lives, etc. There are lots of stuff on the internet, do your homework.

    You mentioned she wanted to be a teacher. If she is a registered offender, being a teacher will not happen. There is not a state in the nation that I am aware of that will let her get a teaching license. She needs to find another career path if things pan out as they seem.

    This is a serious FELONY charge she is looking at. Hire the best attorney that money can buy. I realize you don't get this all but this is as serious as a heart attack..
    If she gets convicted of a felony, it is likey she will be limited to ANY job that isn't at a burger joint, and from what I'm hearing, not even the burger joints.

    Again its because it wasn't intercourse, it was rape. He is not at the age of consent.

    You should be afraid. It is only difficult to compare a 14 year old boy with 14 year old girl for you. It does not have anything to do with GENDER but AGE. Also it has NOTHING TO DO WITH THE ABILITY TO GET PREGNANT. I seriously thought I heard it all. Should the mother of the boy then be thankful your daughter did not futher violate their son by not obligating to child support? This makes no sence at all.
    Whether I had a son or daughter, I too would proscute to the fullest extent of the law. Get your daughter into counseling as soon as possible.

    Statutory rape to sexually penetrate a person at least age 13 but less than age 18 if the actor is at least four years older than the victim. Any actor under age 18 must be tried as a juvenile and cannot be transferred to adult court.
    Two to six years in prison

    I would suggest that she see an OBGYN and get a full exam to prove that she does not have any STD's or the like. She needs to protect herself from any claims he may make later.
