Last june my family and I moved to my house from the other side of the country (hubbys in the Military) we entered into a 1year lease and just had issue after issue since then. we put down a 3000 dollar deposit which is more than half the rent! when we moved in the house wasnt even finished. we had no carpet, no kitchen,no shower no electric, and mice!!!! (ewwwwww) but we had no where else to go at the time so we stayed. after everything was resolved aseticly we still had no plumming in the bathroom( toliet would not flush) for about a month to my landlords knowledge, then the kitchen sink backed up as soon as we got the toilet fixed, for about a month to my landlords knowledge while he got those things fixed we have had no heat since day one while it wasnt a big deal in the summer its a real big deal now in the winter! he as came to look at it and said it was the thermostat and never came back to fix it, but has been over on several occations to pick up his rent!
I HAVE 4 YOUNG CHILDREN! the mice have brought roaches, my husbands we have recently been told that we could move into base housing and i gave my landlord a 30-day notice he has told me that if cannot find another person to take over my lease, HE will not be paying the mortgage and i will need to come up with the rent i told him in december that we could'nt afford to stay here anymore because of a pay cut my husband recieved and showed him documentation. but its not about the money its more about the on going health issues in this house my family has stayed sick due to his neglegence to fix the heat my SDGE bills have tripled because i have to keep the gas oven on for heat, all i want him to do is let me out of my lease do i have a chance or should i let this go to claims court?

You signed a lease and unless Landlord has breached it you are stuck for rent for duration of lease or until new tenant is found
He has breached the lease by not fixing the heat and i have also been denied my right of quiet enjoyment because of previous owners of the home comming to collect belongings in the back yard people moving cars out of the yard all stating they have his permission! should i get a lawyer and fight this in court? like i said i dont want any money back i just want to leave he can have the deposit although there are no damages. i just want him to let me leave and the deposit is 2 months rent and then some!
Take your lease to an Attorney.
my question is i want to break my lease early due to the fact that we have had no heat, the whole winter, he said it was the thermostat and has never returned to fix it, we have had a mice problem he has left unaddressed and the mice have brought roaches and the have almost invaded the house i have 4 small children (9,7,6,& 1) and there healh has also been affected by this. i have given the LL a 30-day notice to terminate the lease and move. but he is telling me no that if he doesnt find another family to rent this house (and he wont) tha i will have to pay
I have witnesses to all my facts and a laundry list of others if we go to court it will get nasty is there anything i can do to get out of this lease without having to fight him in claims court or would that be the better bet???
Did you attempt to have someone fix the thermo?
The vermin problem is something you could solve with a trip to the local discount store to buy vermin poison.
yes we have had people come in about the thermostat but would not do the job because we are not the home owner and when we asked him to give us permission he said no he woudl fix it!
as far as the mice i have spent about 200-300 a month in mouse traps trying to atleast keep it at bay but there obviously are more of them then there are me!!! we change out every trap atleast every other day thats how bad the problem is! i dont want my kids in this any longer.
