How Are You Able To Transfer State Parole?
ive been reading through the forum and i see that all these people are able to transfer state to state but my fiances' parole officer is not allowing him to move with me from new mexico to denver. parole officer says he must wait until his mother moves since he has paroled to her house. what can we do? is it all decided by the parole officer? or are there rights he might have to be able to transfer home to me. our initial plan was for him to parole straight out of the correctional facility in new mexico to denver but his counselor in the jail advised him to wait till he was out to start the transfer. unfortunately it made it harder and weve not been successful in convincing the p.o it would be in his best interest to move out of the state into a better environment. any advise from anyone on who we can talk to or how we go about it?? any help please:confused:
Re: How Are You Able To Transfer State Parole?
It's pretty much up to the parole officer. It's possible to bring a motion before the court to try to get permission, but the odds of the court overturning the parole officer are slight. Also, it takes coordination between the parole departments of the two different states to effect a transfer.
Parole officers usually want a reasonable track record of compliance with parole before considering a transfer. Being authorized to hop on a bus to another state the moment you get out of prison? That would be extremely unusual.
If your boyfriend wishes, he can hire a criminal defense lawyer to advise and assist him.
