    Did I Properly Serve A 60 Day Notice?

    Hi. Yesterday I had a process server vome by to serve up a 60 day notice to someone I live with. I own the house, they just live here. I was told I shouldn't except the notice, and the person who it was being served to wasnt home, so the server 'nailed and mailed'. Then the attorney who filled out the form for me told me to take that notice, and take it on his bedroom door. And I received the letter that was mailed and put it in his room.

    However, a friend of his came by and picked up the mail for him (the guy im evicting was staying somewhere else for a while.) and later he actually came by, but did not take the notice off his wall.

    I put the letter into his room and the notice on the door. If someone else comes by and takes the letter and this guy does not take down the notice, is he gonna fight it and say I didnt follow proper procedure? And if not, can I just hand him the notice next time he comes even though I already taped it to his door?

    I am uncertain if a process server is needed for a notice to vacate but better safe than sorry. This site may be of use as it answers many questions
