Custody Or Emancipation In Oklahoma
Hello I am need of some answers my daughter lives with her father and stepmom in oklahoma... she is 14 yr old and pregnant .. the father of the baby is 16, does have a job and is standing up and wants to care for the child and my daughter .. Her father says she has no right to her baby and say he will have custody of the baby until she of age.. She wishes to move out and in with the father of the baby and his parents.. As they want also!!
Her father abused her last month,, I just found he hit several times with a belt in the head and face and she was 7 months at the time . I told my daughter to call cps but she is scared that she get in more trouble from himi if nothing is done and he will take her baby..
They live in a very small town
Is there any laws that protect her right of custody of her baby
and would she be able to emancipation base of the abuse

Why don't you go for custody of your daughter? She is not going to be emancipated so that she can go live with her boyfriend who knocked her up.

We are still in court concerning custody of my daughter
and I was asking about the emancipation because of the abuse..and the neglect.
I understand they were wrong for doing this but he is willing to stand up and take care of the baby.. He has a full time job and go to school and also has purchase everything for the baby.

The Father himself is but a child. He may certainly seek custody but he has to prove paternity first

I think the OP is talking about the father of the teen mother.
Emancipation is all about self support. Living with the boyfriend's family isn't going to count. Your daughter would need to be able to show a court that she makes enough money to support herself (and now her child too), and has a plan in place to finish school, etc. Emancipation has absolutely zero to do with abuse. The way to address abuse MUST be through CPS.
With that said, the mother's father doesn't have any type of legal right to his daughter's child, unless and until a COURT orders otherwise. And just so there's no confusion, the mother of the child MAY be considered MEDICALLY emancipated (depending on her state) - but that only means that SHE gets to make MEDICAL decisions concerning herself and her child (emphasis on HER child) - it in NO other way means that she is free from dad's parental control and authority. Her only legal way out, unless dad ALLOWS her to go, is through CPS or waiting until she reaches the age of majority in her state.

And the ONLY state that will even CONSIDER emancipating a 14 year old is California, regardless of the reason, and for a 14 year old in CA to be emancipated that 14 year old had better be either a successful child athlete or a nationally recognized sports figure.

I don't know anything about law, but is it possible she could take pictures of the bruises, and have a recording tape when he yells, call the cops, then you can file for custody, while he's in jail, and when you get custody have her get an emancipation, so she could live with her boyfriend?? I don't know, but just an idea, I would get PROOF and call 911, have it ALL over the media, so that the court HAS to do something, and that jerk will get locked up, and hopefully "drop the soap" in jail hehe, if you know what I mean ;)

Megan she is not going to get emancipated to go live with her boyfriend.
She is 14 years old!!! She is just a kid.
To get emancipated it would have to go in front of a judge. Oklahoma emancipation statutes are limited, they address giving rights to minors so that they could have the legal right to contract.

far as self supporting she cant work at her age but her boyfriend does and makes enough to support her and the baby
plus his parents want this and have plenty of room for her and the baby
his mother work at home and would be able to care for the child while she finish school...
would she be able to marry due to the pregnancy and my consent ?
but i only have joint custody and that if I live in ok but I live in missouri
my lawyer was trying to modify custody for I move home where we both were from orginally until I made a trip to ok and he pull her from me and not seeing her for almost 10 yrs and been fighting him ever since ..would I be able to get constent>>??
i dont know what to do I so confuse
we are still fightin in court but right its at a stand still for I dont have the money to continune

A 14 year old will not be allowed to marry unless the court approves it.

Grandpa to be, still has legal custody of the pregnant teen.
If the home is not fit, CPS may come in and remove the minors.

Why on earth would you want your FOURTEEN year old child to live with the boyfriend that got her pregnant? So by 16 she will be the mother of 2? You will never EVER get custody of this child if you are promoting her living with her boyfriend or marring her off at the age of 14! She is a CHILD! 14!
Instead of trying to come up with some convoluted plan to get her away from her father, call CPS and report the abuse. NOW!

No. I would report the abuse to CPS. I would motion for custody as your daughter getting pregnant under Daddy's watch is a significant change of circumstance. But I would NOT send her off to her lovers home to be a sex toy. I would NEVER send my 14 year old child off to live with her boyfriend. Never. The thought is insane. It is not in her best interest.

What I meant by the above statement is if you were to allow your child to live with her bf, by the time she is 16 she will have two children.
