    Public Intoxication Charges
    HI, my name is Pedro Leal and I was arrested with PI last Sunday.
    The judge told me that if, among other options, I say that I was publicly intoxicated and I accept to perform some community service, pay a fine, and go to some educational classes, I can have the charge taken off of my record.
    I need to know if it is true. I would appreciate if someone could tell me if it is a possibility.
    Just for further information, I would like to know what constitutes "public intoxication?" I was "drunk," although I was not threatening anybody in anyway. I was not being loud and I did not cause any trouble to the police officers that arrested me. I am a Brazilian citizen married to a lady from Texas. I have my green card, my social security number, and have never been arrested here or anywhere.

    Do you know the precise statute or ordinance under which you were charged? Public intoxication does not ordinarily require more than that - intoxication which occurs in public - but it is impossible to know for sure without looking at the actual law.

    I don't know why the judge would mislead you about the likely sentence. If in doubt, confirm the judge's representations with a local criminal defense lawyer.
