Michigan - Retail Fraud 3rd Degree 1st Offense
On 1/8/08, the Mich. State Police came to home to ask me some questions in their patrol car. I agreed without hesitating as I thought it was related to my brother. The officer told me I wasn't under arrest nor did I have to talk to him or answer his questions and was free to leave the vehicle at any time. I told him I didn't mind and would answer any questions he had. He proceeded to ask me multiple Q's regarding my being admitted to the local hospital around Sept. '07. I told him I was in the ER for a head injury that occured on 9/1/07 but I didn't remember how I got to the hospital or leaving the hospital. He asked if I was medicated in ER & I told him "very much so." He asked me where I went afterwards, I told him I didn't know. I told him I don't remember the following 6 weeks after my accident. I asked him if I hit somebody when I left the hospital, he said no. He proceeded to tell me that I went to a gas station and am on surveilance cameras pumping gas and wandering in the store for an hour picking up various items and placing them on the counter. He said a stranger came over to me and asked if he could help carry my (3) bags of junk food to my van, I told the clerk I would be back to pay my bill & I didn't return. I don't remember this at all, and I told the officer that I would like to talk to the gas station to resolve any problems I may have caused. I offered to pay the bill and the officer told me not to worry about that & he would get back to me. Today, I found out there has been a bench warrant issued for me with this crime. I have never been in trouble, my bank account had $1,100 in it at the close of 9/4/07, I would never do something like this - ever! I am a Little League coach, mother of twins, decent citizen and got my injury from being a Designated Driver during a community event. I am devastated and don't know what to do. This crime is not in my nature. Any advice, direction or help would be greatly appreciated. Thank you!

If your going to use your medicated as a defense I suggest you find a Lawyer who will support you in that effort. You will also need the ER records and scrips you were given etc.
