    Custody From Delaware To Georgia
    Due to a mothers inability to be a parent, my husband and I got a legal modification of custody for our stepson to live with us for the school year. The school year will be up in the end of May. We have since found out many reasons that my stepson should not return to his mother in DE. GOOD reasons. Is there a 6 month magic number before we can get GA to take legal jurisdiction over this custody? We would like to petition for another modification of custody, and win full custody of him to live here and not return to DE. We believe we have a good case but want to file here rather than in DE.

    If there is currently no custody or visitation case pending and no custody order, and you want to get an order, you need to do it in the state where the children have been living for the last six months. If there's already a custody order and you want custody or visitation changed, you have to go to the courts of the state that originally issued the order, unless neither parent lives in that state anymore.

    It looks like you'll have to file in DE. Speak with your attorney about your options.

    I'm curious. What are your husbands "good reasons"?
