Does A FCRA Compliance County Level Background Check Show An Expunged Record
Hi,
I have expunged a misdemeanor case in 2004. My prospective employer is doing background check (FCRA compliance) and I am waiting for the result. The prospective employer is using choicepoint as their background check agency.
Since this is my first background check since the crime, I was getting nervous. so today, I went to the county court and verified the expungement with the court clerk in person. She said case XXXX was granted under 1203.4 PC in 2004. I also ran a instant national/state-wide background check with eFindOutTheTruth.com (they claim to be FCRA compliance) and report came out clean.
Now waiting for county level check... In theory, if a case was truthly expunged, nothing should come up on county level check correct?
Can anyone confirm this?
by the way, I am in california.

I would not be at all surprised if the original arrest and charge showed up on your record; but the disposition would no longer be a conviction. There is a chance that a private criminal records search will bring up old data.

Even though a record is expunged, if someone was really looking for it, they would find it. The courts are so jam packed today, that all it takes is for one person to miss the memo/notice that they are to dispose of any of your records. Your case goes through many computers and many hands, and finding a way to make sure that all of them are erased can prove quite difficult.
