Re: Getting A Reduction In Child Support Payments
I have been following this thread for a few days. The OP seemingly has blurred vision when it comes to this .....dare I say....man. This man, even though you say you have been with him for 6 years, is not the man you make him out to be. The sad part is that there is always a woman our there who will accept him. He starts by painting a bad picture of his ex's or (baby mamas). The troublesome part comes when the woman choses to procreate with these men. Then the cycle starts over again. Keep in mind, "What goes around, Comes around". It will be you seeking child support next year this time. These type men "take up" with women, procreate and move on to the next one who will have him. We are not on here to beat you up, but take it from me, my situation is close to yours, only I am BM #3 of 4, so my child gets the support which is deserved. I had to fight like hel to get it though. I heard the stories about the others, but when the smoke cleared, he had the problematic life, not them. I own a house, a nice car and have 3 college degrees and Now he paints me out to be the problem to his current. Wake up, you are no different from the others, you bleed red blood too.

However, if an obligor without a second family owes arrears, the max is 65%.

Since the father has not married this woman then should we 'suggest' to the OP that she get legally wed ASAP so the court will recognize his youngest child as belonging to his second family?

Unfortunately that might be in the best interest of their child. I hope the OP had a paternity statement.

I'm suprised that no one has picked up on the fact that the OP and Prince Charming have been together 6 years (per the OP), but Prince Charming has a 5 year old with another woman... yep, sounds like a GREAT catch.

I don't know if your parents ever told you, but a man that will procreate and leave children all over the place is NOT the man you want to have children with. Such irresponsibility should speak volumes about his character. He can't even (obviously) figure out how to use a condom. Such actions will kill you these days.

Ok not that it is any of your business anyways, but me and him got together on June 28th of 2002. his daughter was born in October, so it was before he met me!!! Stay out of my thread with your personal comments please!

That is partly correct depending on the situation.

If an obligor does NOT owe arrears, and does have a second family, the max is 50%.
However, if an obligor with a second family does owe arrears, the max is 55%.

If an obligor does NOT owe arrears, and does NOT have a second family, the max is 60%.
However, if an obligor without a second family owes arrears, the max is 65%.

This is all spelled out in the Consumer Credit Protection Act in Title 15 chapter 41 in the US code-
    http://www4.law.cornell.edu/uscode/#TITLES

Okay it gives me an option of these...which one says that in it?

    SUBCHAPTER I—CONSUMER CREDIT COST DISCLOSURE
    SUBCHAPTER II—RESTRICTIONS ON GARNISHMENT
    SUBCHAPTER II-A—CREDIT REPAIR ORGANIZATIONS
    SUBCHAPTER III—CREDIT REPORTING AGENCIES
    SUBCHAPTER IV—EQUAL CREDIT OPPORTUNITY
    SUBCHAPTER V—DEBT COLLECTION PRACTICES
    SUBCHAPTER VI—ELECTRONIC FUND TRANSFERS

And are these also pretaining to child support cases!

There are some people actually trying to help out, and some are putting in un-needed personal comments! I am just wanting some help for my fiancee', and looking for any legal advice that can be given! I am sorry if I have caused an uproar or anything, cause that is surely not my intention, but I just need help just like everyone else!

What is a paternitly statement? Is that the paper that he signed at the hospital when my son was born with the birth certificate? If that is it, then yes, he did! We are wanting to get married, but I really want a church wedding, right now that is not in our budget at all, so we were trying to wait, but we have seriouly been considering going to the courthouse and doing it, and later when we get financially stable go back and have a traditional one. Do you think we should do this then?

If u mean by getting married at the courthouse and then having a traditional one later, yes, do it. If u feel that he is the one for u, money should not get in the way of getting married. You can always have a large wedding or vow renewal later on or even decide to have the large wedding/vow renewals at the five year or ten year wedding anniversary.
That is what my husband and I did 11 years ago.
As for your fiance's case, I don't know what to advise outside of consulting with an attorney.

I don't know if that was your attempt at trying to clean it up, but let me clarify it for you a little.

You found it endearing that he had knocked up some chick, then left her to get with the next flavor of the month (that, being you). Or... he's such a peach that he knocks up one woman, but doesn't even have the staying power to ride through 40 weeks of pregnancy. Do either of those options sound like either one of you are dealing with a full deck... but you procreated anyway?

Yep... you 2 deserve each other. Good luck and get a child support order for your child also. Hurry up before the next child comes.
