Security Clearance And Court Records

I am currently fighting my X about the amount of child support he pays to me for our 14 year old child in CA. He will tell the judge I am intentionally 'under-employed'. I want to tell the judge that our daughter has some emotional troubles and was diagnosed as having an adjustment disorder with a depressive mood. She is a 'cutter' and so I choose to keep her under my direct & constant supervision which prevents me from working when she is not in school.

I am afraid if I do bring this up in court it will be public record.
When she is an adult could my comments in court prevent her from getting a security clearance and/or passing a background check?

Background checks are generally a criminal background. So unless this has come up when she comitted a crime it would not show. Far security clearence isnt a bit premature (at 14) to worry about that?

She wants to follow in my footstep - a TS-SCI clearance in the USAF :)

If a pysch background is done or if she is interviewed about it. Her cutting could be an issue

I know - that is my quandry. She could just say 'no' to any psych type questions and they would have no reason to delve deeper (this is assuming that she does have a complete recovery) - but if they do dig deep then I am worried they would discover the court records.

I did not mean to refuse the questions - just to say no to having had serious problems in the past or to minimize the problems by saying she was in counseling due to the divorce and not to mention the cutting specifically. You (investigators) can not look at a minor's psych records can you? Other than knowing she went to counseling for X number of sessions - you can not read the shrink's notes - can you?

Its doubtful the mental health issues of a 14 year old (that have not resurfaced) would be a concern or even been seen. The Doctor/Patient relationship is private so no one can see a Doctors notes. the only thing that might be seen would be any mental health history from sources other than her Doctor. Again the issues of a 14 year old would hardly be a concern if not repeated since then

I disagree with panther on this one.
If your daughter chooses to go into the military and answers YES to ANY thing related to counceling (even marriage and guidence) it will red flag her. It won't necessarily prevent her from getting in but it WILL require her to get a waiver for it. If she says no and lies....chances are she will get away with it. The Air Force espically can choose not to take at all bc of any waiver. They have enough people wanting to get in that they don't need to take waivers.
It is highly unlikely that they will find out anything from now at 14 to a possible secret clearance obtained 7+ years from now. When digging for one of these clearances, they might find the court records.
