Getting a Green Card After Criminal Conversion Charges, With No Conviction
Hi - my wife is a US citizen. I'd like to apply for a Green Card. I was charged with conversion in Indiana, plead not guilty, and the charge was dismissed. I assume that I have a criminal record, though was not arrested, no fingerprints were taken and charges were dismissed.
How likely is this to affect a green card application?
This sounds like an idiotic question, but will the INS officer ask if I was guilty - or if I was convicted?
I'll answer all questions I'm asked, but would rather not leap off the cliff if I don't have to do so.
Thanks.
Re: Getting a Green Card After Criminal Conversion Charges, With No Conviction
They will ask about the charge, what happened, and the disposition. We don't know what happened or what you will tell them, so it's impossible to guess how they will respond to that unknown information. If they conclude that you didn't commit the offense, I would not expect it to have any impact on your obtaining a Green Card (save, perhaps, some delay).
