    Hello Expert Laws


    I need some advise.


    Today I was approached by the security dept for the company I work for.
    Making this long story short, the person in charge of the security dept wanted to sit down and speak to me with a witness from our HR dept about some issues that is going on with a different company within the one I work for the provides our food.

    It basically came down to the fact that he was doing some investigation but he couldn’t speak to me about nothing until I sign a document stating that I was ok with this questionnaire and that if I no longer wanted to participate in the investigation, I was able to pull out at anytime. What’s so funny about this is that I was a bit hesitant because he wasn’t able to tell me why he needed to question me and that if I walk out from the room that we where located in, it was going to be looked at an act of insubordination towards the company and I could loose my job.

    So is like I didn’t have a choice.

    Once he made me aware of this, I sign the paper and he proceeded to his questionnaires.

    Apparently one of the cashiers at this lil restaurant that we have in housed operated by a different company just recently got fired because she was apparently under or over charging employees.

    He asked me if I was aware, I said no. I explained to him that my job “business critical” and that I only have a 30 min lunch so when I grave my items I wait for the line, provide my bank card, pay but I really never notice if I was getting under charged or over charged. The 40 min that I was there, this man could of asked me the same question in many different ways, and I answered those the same. I never had any reasons to believe that anything was wrong because I am always rushing. I always make my line and pay. I never notice anything wrong.

    He asked me to write a statement of it and I did. He told me that this will be part of this investigating and it will be compared with the other statements.

    I am here thinking that something is wrong with this picture. I was not treated nicely nor giving a choice, is either to collaborate with us or you get fired. And I feel like I am being dragged into something and I had no clue. My responsibilities are being an honest human being and follow policy and procedures. I feel like I am getting dragged into this. I felt like I was being interrogated by a police officer that basically read my Miranda rights but I couldn’t use them.

    Can an employer do something like this to an employee?

    Miranda does not apply in that type of situation so forget that. Next the threat although unfair was not illegal. Unfair is not always illegal such is this case. Without saying you rlieing (I am not saying this) I can see where someone would find it difficult to believe you were not aware of under or over charges on your meals. At this point you could be part of the investigation as a suspect but they want the big fish more than you. You might consult an Attorney as its possible they could charge you with theft if they feel you knowingly accepted meals for reduced price. Do not agree to anymore questioning before talking to an Attorney. My guess is you will be calle din again for possible more questions, discipline, firing or arrrest for theft charges. Talk to an Attorney before being called back in

    I agree that the questioning was not illegal but would also suggest you talk to an attorney.

    In a matter of me posting this in your site, 30 min later I was fired for dishonesty. They thought I had part in this. I need legal advise!!!!!!!!!!!!!

    Which is exactly what I told you! You do nothing unless charged. Its legal to fire someone for "suspected" theft. Remember this?

    I didn't do anything. I was approached by one of our supervisors and she told me that my manager wanted to speak to me about my concerns that I had with the way the guy from security simply told me that I basically had no choice. I was concerned about that and she wanted to follow up with me about that. I didn’t speak to no one else. As she approached my concerns, then she took a moment and told me that I was getting let go. The same person from HR was there. I mean I have my manger wanting to make sure that everything was on for my perception, but I got let go and wrongfully accused????
    This doesn’t make any sense to me. What else could if I done. If would of refused to talk to her then I would of gotten fired for something else like disobedience and simply being a rebel.

    Nothing illegal took place just be glad they did not charge you with theft. Its doubtful you would have retained your job no matter what you said. They were trying to build a case against other person and wanted your help.

    And because I couldn’t speak of something that I had no idea then this is the cause? I mean I just simply don't understand. I didn't steal. I wasn't the person getting big means and knowingly under paying. All I consumed at this place was 2 drinks a day and a breakfast bar.

    So where the defamation of character is comes in to play? I was let go because I was dishonest and I was a liar. How can I be for something that was completely out of my control? My job was not the cashier. That was her job she was charging me. I have been working for this company 3 years. I used to come in the morning buy a drink and breakfast bar and at lunch refill my drink and get a yogurt every now and then. Upon my discharged they had some copies of receipts showing that she was charging me 60 cents. They didn’t even show me the dates asked for copies none were given to me.
