    Alright, im sorry but who is the DA? and i would mention the Diversion the day, during the court apperance? Or when we recieve the letter in the mail telling us the date and all the information?

    The DA is the Attorney for the state. When you get letter there should be contact info on it

    If you can...Coming from your experince how do you think this case might go if we go to court on the date dont hire a laywer and he cooperates, makes his plea, and me and my husband say our part and we mention the diversion plan. This being his first offense, and having a clean record prior to this.

    As I told your son the likihood of jail is almost zero. Diversion programs vary and are not available in all counties so its impossible to speak on them

    If you thought you didn't like the attorney that you paid $4500 to and the case blew over without reaching court, imagine how well you will like an attorney that the STATE pays $45,000 to a year.

    That $4500 you spent may have actually been money well spent. Many times well-paid attorneys appear as if they are spinning their wheels when in fact they are working or delaying things. Where I come from $4,500 buys about 30 hours of an attorney's time. If they finish out of court with 10-20 hours in they make a profit. If they go to court for 2 days and spend 3 days total (1/2 day prep) plus 10 hours talking then they have lost money. Pay more money, get more time.

    The best tactic that attorneys can use is continuing a case and getting discovery information. Sometimes those who would testify don't show up. You see, there is this great constitutional law that allows US to confront the accuser. If they do not show up then we can't confront them. ...and the prosecutor has few legs to stand on.

    To the Mother Concern: If I were you I contact Macy and ask if they will drop the charges and willing to pay for the item that was taken. Then keep an eye on your son or daughther who did this and tell him or her why it was wrong to do that I don't think that he or she wants to go to jial this is the best way.
