    I have a question and will try to keep it short. I have been married for 3 years and we have a 4 yr old son together and my wife has a Stepson 14, I also have another son from a old marriage who is 11. me and my wife have lived together for 11 years. My wife now is going though some depression and mental isssues and has not worked for 6 months. and does not intend to go back to work. she filed a DV complaint against me and packed up the house and kids and moved to Utah 3000 miles away we live in NJ. the court ordered her to return she did she moved back into the marital home, She know advised me she is now going to ask the court for permission to move to Utah were her family lives. I am against the move because of the very little parenting time I will receive. and also my other son feels his brothers are going to be taken away who he sees every weekend. what are the chances the court will let her move to utah and remove at least my son out of state? do the courts look at the issue that he has another brother in the currant state and alos other grand parents and so on? she is saying she will get a job out there in utah and she just wants to be near her family. but only thing here is she has lived in NJ for 18 years. I feel she is just trying to take the kids away form me. please any help would be greatfull.

    Matt, we have no idea how the court will rule in the matter of custody.

    You need to work this out with the pros and get a good divorce lawyer.

    If it makes you feel any better, I know of at least three similar situations (one parent wants to move several hundred or several thousand miles away) and the courts have said "Forget it, pal." in all of them. There is hope. You can fight for your kids.

    Thanks for the reply. I guess it is just a wait and see game. I do have an attorney, but really do not talk to her much because I cant afford it... lol My wife soon to to x- is doing this all on her own with no attorney.
