Fiancee Deported For Drug Charge
My fiancee was deported in 1996 for a felony drug charge. When he was deported he was given a 10 year bar. When he was 6 his mother died and his father brought him to the US. We have recently learned that his father became a citizen before his 18th birthday. Does this make him a citizen as well? If not, can I marry him and then apply for him to return?
Re: Fiancee Deported For Drug Charge
His father's naturalization does not result in his automatic naturalization.
From what you say his period of ineligibility is now over, so he is free to seek a visa to enter the United States. His drug conviction could interfere with his getting a visa.
Re: Fiancee Deported For Drug Charge
from what i understand ,if your fiancee can prove that he was under his fathers custody before and after his father got citizenship, that makes him a citizen ,but he'll have to prove it in court and that in itself can take alot of time and money.an immigration lawyer can help you better than i can.you should really look into this option.
