Placing A Public Notice Disclaiming Debts Incurred By Ex
Does anyone know anything about this?:
I live in Florida. My boyfriend is divorced and his car and his ex-wife's car are both in both of their names thru the same bank. His ex is always months behind on her payment and the car actually got repo'd this week, however she is paying the PD balance and is getting it back. I've heard something about placing an ad in a newspaper to the creditor (the bank) stating that he is no longer responsible for that car's debt (the divorce papers say she is totally responsible for the payment of her car) and once it has run, he can take it to that bank and then they have to take him off the loan? Or force her to refi in her name? Does anyone know the details on that or can anyone explain it in more detail to me? I've tried to look it up online but have come up with nothing. Thanks!!

As far as I know, there is nothing that allows the type of action you describe. The divorce judgement isn't binding on the bank. She can refi the car into her name only, but unless she does so, he will be equally responsible for the debt. His recourse is to sue the ex-wife for the money it costs him to make it right again.
