Fraudulentlly Collecting Welfare Funds
I received an overpayment of funds in 1992. I was charged with welfare fraud in 1997 and received 3 years probation and restitution. My Ohio state taxes were being turned over for payment of the funds. The food stamp portion was taken out of my federal taxes in 2004 and was paid in full. My :confused:state taxes haven't been touched since 2004. However, I received a letter in November 2007 stating that I still have a $2000 money balance. Is there statutes of limitations on how long they are allowed to collect on these funds? Can this case be included in bankruptcy (chpt 7)? I filed in 2004 and included them, so I thought it was done.

Debts incurred due to fines or penalties for violating the law or debts incurred through fraud are not dischargeable.

The statute of limitations applies to the prosecution of the crime, not the collection of the penalties and restitution. The state is entitled to collect the full amount of the judgment rendered against you, regardless of how long it takes.
If you are convinced (or have supporting documentation) that you do not owe the sum demanded, gather your documentation and get an attorney.
